General Terms of Point of View Designs

Point of View Designs will design the website / CD-Rom Presentation / Posters / Graphic Design / Brochures with the design concept agreed upon by the customer. Point of View Designs will prepare a draft of the project for approval before we continue on the project.

Once the customer gives the approval, we will use the text provided by the customer in an electronic format (Microsoft Word format). Furthermore, the customer agrees to provide all logos, photos in a digital format. For Website projects, Point of View Designs will, design the website, publish the website to the ISP (Internet Service Provider) of customer's choice. It is the responsibility of the customer to ensure that the Internet Service Provider has all the required server extensions configured for Macromedia Flash 4.0/5.0, Macromedia Dreamweaver, Microsoft FrontPage 2000, or HotMetal Pro 6.0. We will make reasonable effort to resolve any incompatibilities with your ISP of choice.

As soon as the website design is completed, we will publish the site to our website (www.point-of-view-designs.com), so that the customer can view the page and make a request for final changes. Once the final approval is granted by the customer and all payments are made by the customer, the website will be published to the web server with your own domain name.

Once the website is published to the web server of customer's choice, if any changes are made to the website by any person or company, other than employees of Point of View Designs, we will not be responsible for any damages. In such event, Point of View Designs will repair the website and will bill you at our normal rate per hour. The invoice is payable upon receipt.

All images, backgrounds and all contents of website are the property of Point of View Designs until full payment is made for the work performed by Point of View Designs. All images and backgrounds will contain Point of View Designs watermarks on the all areas of the website until all payments are made.

Furthermore, it should be noted that, the customer would provide the domain name and the content. The customer agrees to give permission to Point of View Designs to use all content to the end of developing the website. Moreover, by signing this agreement, the customer agrees to assume all legal responsibility for the content of the website throughout the universe and for all time.

When we complete the project, we will add your domain name to our portfolio on our website with a link, thereby creating additional traffic to your website and you agree to include our company name with a link in your website as the designers.

Fees
Point of View Designs and you will discuss the estimated cost before we start on the project. 50% of this amount is required before we start on the project. As soon as we receive the 50% of the total charge and the customer has provided all required text in a electronic format, logos and any other material required to design the website, the website will be completed within the agreed time frame. The balance of the payment is required as soon as the project is completed. Once the final payments are made by the customer, the website will be published to the web server with your own domain name.

Once the website is completed, if modifications are necessary, Point of View Designs will bill you at our normal rate per hour. The invoice is payable upon receipt.

Maintenance Contract
We will undertake to do maintenance of the websites we create at a price agreed upon. The maintenance contract will cover only the updates and changes in the content of the existing website. Any structural and design changes are not included in the maintenance contract.

Customer agrees to pay for the annual subscription of the domain name to Network Solutions.

If the customer decides to change the web hosting company, we will perform the functions that are necessary to complete the project. (Limited to once a year)

Search Engine Registration
We will register the customer's domain name in search engines and customer's specific trade websites. We will also prepare Meta tags, Keywords, and site descriptions suggested by the customer. We will help the customer to make those decisions. Please note that it takes a minimum of 6 months for majority of search engines to rank your domain name. Some search engines charge a fee to guarantee a high ranking in their search engine. Customer agrees to pay the cost for the registration in search engines, trade websites and other publications that require a fee.

No materials from the Sites may be copied, reproduced, republished, uploaded, posted, re-deliver using framing technology, transmitted or distributed in any way without Point of View Designs written permission; provided however, that users may print one copy of the materials for use in learning about, evaluating or acquiring Point of View Designs services or products. No other permission is granted.

Trademarks/Copyrights
The content of the Sites, including all text and graphic images, is copyrighted by Point of View Designs, its affiliates and/or the original copyright holder. The trademarks, logos and service marks displayed on the Sites are registered or unregistered trademarks of Point of View Designs, its affiliates or others. Nothing contained on the Sites shall be construed as granting, by implication, estoppel or otherwise, any license or right to use any trademark or copyrightable material displayed without the written permission of Point of View Designs or such other third party that may own the trademark or copyrightable material.
